Welcome to the Smartly.io Community! In our Community you can connect, collaborate and communicate with other Smartly.io users, industry experts and thought leaders to stay up to date on industry trends, improve your advertising strategies within Smartly.io and across all online platforms and campaigns.

Our Community is here for everyone. However, we want to make sure that the Community offers a positive experience for all visitors. Our Community will be most valuable when all users follow certain basic guidelines and rules which are laid down in these Terms.

These Community Terms and Conditions (“Terms”) govern your access to and use of the Smartly.io Community site (“Community”) provided by Smartly.io Solutions Oy and its affiliates (together “Smartly.io” or “we”).  

We reserve the right to update or modify these Terms with or without a notice so by continuing the use of our Community after the revised Terms, you accept the revised Terms. If we deem the changes to the Terms to be material, we notify you of the changes. If you have any questions or issues, please let us know via a mail to community@smartly.io.

 

Be friendly and stay legal

Treat others with respect and only use the Community for its intended purpose. Be mindful of the fact that this is a global Community. You are not permitted to post or otherwise transmit any

  • content that is racist, offensive, pornographic, insulting, harassing, hateful, unlawful, sexist, discriminatory, false, deceiving, threatening or otherwise harmful, and you cannot use coarse language, make inappropriate jokes or otherwise harass other users; 

  • viruses or harmful code;

  • content in a manner that would violate any intellectual property rights or any other rights of third parties;

  • personal or private information (such as telephone numbers, email addresses, etc.) that is not your own; 

  • confidential information or trade secrets such as non-public information about Smartly.io; or

  • content in a duplicative or excessively repeated manner or in a way that would be considered spamming such as advertising and chain letters.

Neither can you: 

  • impersonate other persons or falsely associate yourself with Smartly.io, other company or other person;

  • scrape, data-mine or otherwise harvest any information from the Community; 

  • engage in phishing or any other type of fraudulent or illegal activity;

  • circumvent any technical controls or measures in the Community or make the Community available for others by reselling, redistributing or otherwise; or

  • in any way interfere with the operation of the Community. 

 

Stay on topic

Do not change the subject of a discussion to something not intended by the original poster. Any off-topic posting or “hijacking” of threads will result in content being removed and ultimately can cause you to be denied access to the Community.

 

No commercial use

You are not permitted to use the Community for commercial activities such as: advertising or sale of products or services, interactive games, other chat forums or other websites; sending of commercial messages, spam, solicitations, referrals or comparative claims about Smartly.io or other companies.

 

Your account

You may not own multiple accounts on the Community. If Smartly.io detects double accounts, all secondary accounts can be removed by Smartly.io. Smartly.io also reserves the right to remove or modify accounts and profiles that violate these Terms. You need to use all reasonable efforts to prevent unauthorized use or access to your account and credentials and you will need to notify Smartly.io immediately of any such unauthorized use or access.

 

Content and moderation actions

By submitting or making available any suggestions, comments, posts, messages, ideas and information (“content”) in the Community, you grant Smartly.io an unlimited, irrevocable, perpetual, and royalty-free license to use the content freely for any purpose and you agree to have the authorization to grant these rights.

While Smartly.io assumes no obligation to monitor any of the content in the Community, Smartly.io reserves the right to change or remove content or to restrict or revoke access to individual users in its sole discretion. You are not permitted to discuss any moderating actions made by Smartly.io. If you have questions regarding any moderating actions, then please contact community@smartly.io.

 

Be careful and responsible

You acknowledge and agree that you are using the Community at your own risk and that you are solely responsible for the actions you take and the content you share and access in the Community. You agree to hold us harmless from any claims made by any third party relating to the content you post, your use of the Community or your violation of these Terms. Smartly.io provides the Community “as is” and “as available” without warranties of any kind and will in no circumstances be liable for any indirect or consequential damages. Smartly.io may at any time discontinue or modify the Community or part thereof. Any information you share in the Community can be accessed and used by others and your profile information is visible to other Community members when you use the Community. Smartly.io is not responsible for the information or content posted on the Community, its accuracy or for the use thereof. These Terms will be governed by the laws of Finland excluding its provisions relating to the choice of law.

A cookie is a small piece of information that is stored on your computer as a file. Cookies enable us to recognize your device on a subsequent visit.  See below how you can manage your cookies.

 

How we use cookies

Information we obtain from cookies are used to provide and analyze our community. We use this data to adjust the community to your personal preferences. You may also permit the use of cookies to get a more complete experience and to allow us to perform marketing. Finally, when sending information about our products and services, we can take your previous interest for certain pages into account. Certain information about your use of the site is shared with our social media, advertising and analytics partners who may combine that information with other information you have provided to them or which has been collected from your use of online services. Such information is also shared with and collected by the third party platform provider (currently InSided) as made available here (and further explained here) for the provider’s own purposes and may be similarly shared with other Smartly.io group companies.

 

Cookie setting

You choose which cookies you want to allow. You can do so by clicking on the “Cookie settings” link in the footer of any page, and adjust your preferences and submit.  There are 3 settings: Necessary, Normal and Complete.

  • Necessary: Functional

  • Normal: Functional + analytics

  • Complete: Functional + analytics + social media (including marketing) + embedded videos

 

Refuse cookies

You don’t want to use cookies at all? We still need to deploy necessary cookies if you wish to use the Community but you can always visit the help pages of your browser to turn off or reject non-necessary cookies or click the “Cookie settings” as mentioned above to manage your consents. Be aware, it is possible that not everything works or is displayed correctly when refusing cookies.

Tracking / Analytics

We collect browsing data from you to continuously improve your experience. We will not spam you nor sell it to other parties. You can always choose not to allow the deployment of tracking / analytics cookies.

 

Personal Data notice for Community

“Smartly.io Community”

If you use the Smartly.io Community site (“Community”) we’ll process the personal data derived from or submitted by you in connection with your access to and use of the Community, including for example:

 

  • Email address and user name

  • Account ID (if you are a Smartly.io advertising platform user)

  • Information you may provide as part of your profile such as job title, social media profile URL, description about yourself, country, company and profile picture

  • Log information

 

The personal data is used to give you access to the Community, allow you to post and view comments and content in the Community and Smartly.io may also analyze and moderate (in Smartly.io’s discretion) the use of the Community.

 

We process the Community related personal data in order to perform the contract between Smartly.io and the users of the Community.

 

The personal data may be shared, as necessary to provide the Community, to other users and our suppliers such as the third party platform provider and Smartly.io group companies. The data may be shared outside the EU and transfers are performed subject to standard data protection clauses adopted by the EU Commission in accordance with the GDPR, which are made available to the data subject upon request. Based on your cookie settings in the Community, your personal data may be shared to third parties. 

 

We retain your Community account data until you have removed your account or we have done the same as per your request. We retain the log information for 12 months after your account has been removed. Note that your posts and content will remain available in the Community even after your account has been removed but appear as coming from “Anonymous”.
